TERMS & CONDITIONS

Participation in the competition of Ethnotek, hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these conditions of participation.

DURATION
The duration of the competition is from 25.05.2023, 18:00 (EST) to 25.06.2023, 18:00 (EST). During this period, users will have the opportunity to enter the competition online.

PARTICIPATION

1. Instagram sweepstakes participation

Users will have the opportunity to enter the Instagram sweepstakes from 25.05.2023, 18:00 (EST) to 22.06.2023, 18:00 (EST).

To participate in the sweepstakes, the following are required:

  • ●  Following the @ethnotekbags and @selinaguatemala Instagram accounts.

  • ●  Liking the @ethnotekbags Instagram post from 25.05.2023

  • ●  Tag 1 friend in the comments

    An infinite number of entries per participant can be made via commenting and tagging a person under the post, thus increasing the chances of winning.

2. Email signup participation
Users will have another opportunity to enter the competition by using the email signup form from 25.05.2023, 18:00 (EST) to 25.06.2023, 18:00 (EST).

    To participate using the email signup form, the following are required:
      • Sign up at Ethnotek.com/pages/win-a-trip using a valid email address

      An infinite number of entries per participant can be made via referring others using the personal referral link, thus increasing the chances of winning.

      Participation is only possible within the entry period. Entries received after the closing date will not be considered in the draw.

      Participation in the competition is free of charge.

      ELIGIBLE PARTICIPANTS

      Participation is open to natural persons over the age of 18 (and to persons over the age of 14, provided that their legal representatives give their written consent to participation). Participation is not limited to customers of the organizer and is not dependent on the purchase of goods.

      Only entries made from a public Instagram account can be considered. Private accounts can unfortunately not be considered.

      Should a participant be limited in his/her legal capacity, the consent of his/her legal representative is required.

      Not eligible to participate in the competition are all persons involved in the conception and implementation of the competition and employees of the operator as well as their family members. In addition, the operator reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example:

      • ●  in the event of manipulation in connection with access to or implementation of the competition,

      • ●  in the event of violations of these conditions of participation

      • ●  in the event of unfair practices or

      • ●  in the event of false or misleading information in connection with participation in

        the prize draw.

        If the winner does not respond after two requests within a period of 3 weeks, the prize may be transferred to another participant.

        PRIZE, DRAW, NOTIFICATION AND TRANSFER OF THE PRIZE

        1. Prize
        The grand prize from the Instagram sweepstakes consists of the following:

      ● A trip for two to Guatemala (11/10/2023 - 11/19/2023) including:

      • ○  Roundtrip airfare for two people with the condition that the departure airport for the outbound flight and the destination airport for the return flight are the same

      • ○  Accommodation for 8 nights

      • ○  Ethnotek Starter Package worth $500

      • ○  Artisan visit

      • ○  Volcano Hike

      • ○  Yoga and wellness activities

      • ○  Ethnotek plans and accompanies the trip in its entirety

        The grand prize from the email signup content consists of the following:

        The pictures in the sweepstakes post dated 05/25/2023 are for illustrative purposes only, the actual accommodation may vary depending on availability for the desired travel period within a similar standard.

        2. Drawing and notification

        Within the competition period, the operator will draw a winner for a partner prize package on four different days (30.05., 01.06., 06.06., 08.06.) each at 18:00 (EST). The winner will be determined in a random draw among all participants. They will be informed by direct message. In addition, the operator reserves the right to mark them in the draw story on Instagram.

        The winner of the main prize from the Instagram sweepstakes will be drawn at the end of the period (22.06.2023). This drawing will take place by random drawing on Thursday, 06/22/2023. At 18:00 (EST) on the @ethnotekbags Instagram account the result will be announced and the winner will be informed.

      The winner of the main prize from the email signup participation will be drawn at the end of the period (25.06.2023). This drawing will take place by random drawing on Sunday, 06/25/2023. At 18:00 (EST) on the @ethnotekbags Instagram account the result will be announced and the winner will be informed.

      3. Transmission of the prize

      Any costs incurred for the shipment of the Ethnotek Starter Kits will be borne by the operator.

      The delivery (incl. booking of flights and accommodation) of the prize will only be made to the winner or his/her legal representative. An exchange or cash payment of the prize is not possible.

      Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.

      The winner is responsible for any necessary requirements, documents, etc. for entry into the country, and any costs incurred in this context are also to be borne by the winner.

      If the winner does not report after two requests within a period of 3 weeks, the prize can be transferred to another participant.

      The winner is obliged to decide for or against the prize within 30 days after the draw. For this purpose, a contract will be drawn up between the winner and the organizer and signed by both parties in the event of acceptance of the prize. If the winner decides against the prize, the prize will be transferred to another participant.

      TERMINATION OF THE COMPETITION

      The organizer expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.

      DATA PROTECTION

      The organizer points out that all personal data of the participants will neither be passed on to third parties nor given to them for use without their consent.

      In the event of a win, the winner agrees to the publication of his/her name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the website of the operator and its social media platforms.

      The participant may revoke his/her declared consent at any time. The revocation must be made in writing to the contact details of the organizer indicated in the imprint of the website Ethnotek.com. After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately.

      LIABILITY

      Ethnotek LLC is released from all obligations upon delivery of the prize. Ethnotek LLC is not responsible for material defects or defects of title in the prize. The same applies if Ethnotek LLC cannot (or can no longer) provide the prize due to business circumstances.

      APPLICABLE LAW

      Questions or complaints in connection with the sweepstakes should be addressed to the operator. Contact options can be found in the imprint on the website of Ethnotek.com.

      The sweepstake of the operator is exclusively subject to the law of the United States. The legal process is excluded.

      SEVERABILITY CLAUSE

      Should any provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these conditions of participation.
